TERMS & CONDITIONS

1. Website Usage: By accessing and using our website, you agree to abide by these terms and conditions, as well as any additional terms and conditions posted on our website.

2. Payment Terms: All services must be paid in full prior to the day of the shoot, unless otherwise agreed upon in writing. We accept payment via cash, check, or online payment platforms such as PayPal or Stripe.

3. Cancellation Policy: Cancellations must be made at least 7 days prior to the scheduled shoot date. If cancelled within 7 days, a cancellation fee of 50% of the total cost will be charged.

4. Changes to Offering: We reserve the right to change our services and offerings at any time, without notice.

5. Warranties: We make no warranties or representations regarding the quality or accuracy of our services, and we disclaim all warranties, express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose.

6. Intellectual Property and Copyrights: All images and videos created by us during the shoot are the sole property of the photographer/videographer, and we retain all copyrights and intellectual property rights. Clients are granted a limited license to use the images and videos for personal use only, such as printing, sharing on social media, or displaying in their home. Clients may not use the images or videos for commercial purposes, sell or redistribute the images or videos, or alter the images or videos in any way without our prior written consent.

7. Model Release: Clients agree to sign a model release allowing the photographer/videographer to use images/videos for marketing and promotional purposes.

8. Turnaround Time: The final images/videos will be delivered within 4 weeks of the shoot, unless otherwise agreed upon in writing.

9. Editing: The photographer/videographer has full creative control over the editing process. Any additional editing requests will be charged at an hourly rate.

10. Rescheduling: If the shoot is rescheduled due to weather, illness, or other unforeseeable circumstances, the photographer/videographer will work with the client to find a new date that works for both parties.

11. Travel: Travel fees may apply for shoots outside of a 25-mile radius of the photographer/videographer's location.

12. Final Approval: The client will have the opportunity to review and approve the final images/videos before they are delivered. Any concerns or issues must be addressed within 7 days of delivery.

13. Liability: The photographer/videographer is not responsible for any injuries or damages that may occur during the shoot. Clients assume all risks associated with the shoot.

14. Indemnification: Clients agree to indemnify and hold harmless the photographer/videographer from any and all claims, damages, and expenses (including attorneys' fees) arising out of or in connection with their use of our services.

15. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of the state in which we are located.

16. Entire Agreement: These terms and conditions constitute the entire agreement between the client and the photographer/videographer, and supersede all prior or contemporaneous agreements or representations, whether written or oral.
